The building law procedure

A building project usually requires a building permit. You receive this through the building law procedure, also known as the building permit procedure. The responsible authority checks whether your building project complies with all building law and ancillary building law provisions. The municipality and adjacent property owners can raise objections. After a successful check, you receive the permit, which grants your building protection as long as all approved plans are adhered to.

The exact design of the procedure varies from state to state and is defined in the respective state building regulations. In principle, however, the procedures are similar in all states.

The various approval procedures

Classic building permit procedure

In the classic building permit procedure, the authority comprehensively examines all relevant building law aspects.

Simplified Building permit procedure

In the simplified building permit procedure, the building regulations are not checked except for the distance area regulations, but they must still be fully complied with.

Exemption from approval or notification procedure

As part of the exemption from approval, you submit the planning documents to the authorities and can start your construction project after a waiting period.

Why are there different types of procedures?

The various types of procedures in the construction industry enable more efficient processing that is tailored to the complexity of the construction projects. Smaller projects can be approved more quickly and with less bureaucracy thanks to simplified procedures. This offers building owners more flexibility and legal certainty, as all relevant legal requirements are met without causing unnecessary effort. This ensures that every construction project can be appropriately examined and approved.

How does the procedure work?

The procedure for building law is basically the same, but differs in the extent of the review by the responsible building supervisory authority:

A: The classic building permit procedure
Here the authority checks the entire scope of building law with all regulations.
The deadline is usually 3 months from the submission of complete documents.

B: The simplified building permit procedure
In the simplified procedure, the scope of the review is limited to building planning law and distance area regulations.
The total period is usually 2 months.

C: Exemption from approval or notification procedure
These procedures apply if a legally binding development plan exists and the project complies with all requirements.
After a waiting period of 2 to 4 weeks, you can start implementing the plan.

D: Projects without procedure
Certain minor construction and alteration measures are exempt from procedures and do not require the submission of plans to the authorities.
Regardless, all legal requirements must be complied with.

How much does a building permit cost?

The costs of a building permit vary depending on the project and region. Here is an overview of the most important information:

Cost structure of a building permit:
Fees from the building authority: These usually amount to between 0.5 and 1.0 percent of the construction costs.
In addition, there are architect costs for a building permit application.

Example calculation:
For a construction project with total costs of 300,000 euros, the building permit fees are approximately 1,500 euros.
Additional costs arise from hiring an architect.
